About the Terms of Service

These Public Terms of Service ("Terms") govern the use of the A3Labs platform, an AI agents solution for sales, support, and operations developed by Monditech Tecnologia e Serviços Cloud LTDA. By accessing or using our platform, you agree to comply with these terms and all applicable laws and regulations. These terms are publicly accessible and do not require login or authentication to be viewed, ensuring full transparency regarding the conditions of use of our services.

Acceptance of the Terms

By accessing or using the A3Labs platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services. These terms constitute a legal agreement between you and Monditech Tecnologia e Serviços Cloud LTDA.

Description of Services

The A3Labs platform offers the following services:

• AI Agents for Sales: Agents that qualify leads, nurture conversations, and run automated sales flows;
• AI Agents for Support: 24/7 assistance via WhatsApp, website chat, and other channels;
• WhatsApp Integration: Connection with WhatsApp Business for direct and group conversations;
• Chat Widget: Embeddable website widget with automated support;
• Scheduling and Calendar: Calendar integration for meeting scheduling;
• Lead Management: Qualification, follow-up, and performance metrics.

We reserve the right to modify, suspend, or discontinue any aspect of the services at any time.

User Accounts

To access certain platform features, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials;
• All activities that occur under your account;
• Notifying us immediately of any unauthorized use;
• Providing accurate and up-to-date information during registration.

You must be at least 18 years old or have legal authorization to use our services.

Acceptable Use

You agree to use the A3Labs platform only for lawful purposes and in accordance with these terms. You must not:

• Use the services for illegal or fraudulent activities;
• Attempt unauthorized access to systems or data;
• Interfere with the operation of the platform;
• Transmit viruses, malware, or malicious code;
• Violate intellectual property rights;
• Use the services for spam or unsolicited communication;
• Share access credentials with third parties.

Intellectual Property

The A3Labs platform and all of its content, including but not limited to software, design, text, graphics, interfaces, and features, are the property of Monditech Tecnologia e Serviços Cloud LTDA or its licensors. You receive a limited, non-exclusive, and revocable license to use the platform in accordance with these terms. This license does not include the right to copy, modify, or distribute the software; reverse engineer or decompile; remove copyright notices; or use trademarks without authorization.

Payments and Billing

Some A3Labs platform services may be subject to fees. Specific payment terms will be communicated before contracting. Prices may change with prior notice; payments are processed securely; refunds follow our specific policy; payment failures may result in service suspension; applicable taxes are the customer's responsibility.

Limitation of Liability

Under no circumstances will Monditech Tecnologia e Serviços Cloud LTDA be liable for indirect, incidental, or consequential damages; loss of profits, data, or business opportunities; temporary service interruptions; actions of third parties or users; or connectivity or infrastructure issues. Our total liability will be limited to the amount paid for the services in the 12 months preceding the event that gave rise to the claim.

Termination

These terms remain in effect until terminated. You may terminate at any time by discontinuing use of the services. We may terminate or suspend your access immediately if you violate these terms; use the services improperly; legal requirements so demand; or for security or fraud reasons. After termination, you must immediately cease use of the services.

Changes to the Terms

We may update these Terms of Service periodically. We will notify you of significant changes through the platform or by email. Continued use of the services after the changes constitutes acceptance of the new terms. We recommend that you review these terms regularly.

Governing Law

These Terms of Service are governed by Brazilian law. Any dispute will be resolved in the courts of São José dos Pinhais, Paraná, Brazil. If any provision of these terms is found to be invalid, the remaining provisions will remain in effect.
